LOST PROFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL
DAMAGES OF ANY KIND REGARDLESS OF THE FORM OF ACTION WHETHER IN
CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT AND SERVICE
LIABILITY, OR OTHERWISE, ARISING FROM THE USE OF THE MATERIALS AND
THIS SITE, EVEN IF CDGT OR ITS LICENSORS HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
If any provision of this Agreement is held by a
court of competent jurisdiction to be unenforceable for any reason,
the remaining provisions hereof shall be unaffected and remain in
full force and effect. This Agreement shall for all purposes be
governed by and interpreted in accordance with the laws of the Government
of Hong Kong SAR without regards to as those laws are applied to
contracts entered into and to be performed entirely in Hong Kong
and without regards to conflicts of law provisions. Any suit or
proceeding arising out of or relating to this Agreement shall be
commenced exclusively in courts in Hong Kong, and you irrevocably
submit to the exclusive jurisdiction and venue of such courts.
